Terms of service

These terms govern the use of the Sunset platform, provided by B Best S.r.l. (Via Baldassarre Peruzzi 13/15, 00153 Rome, Italy — VAT IT16717831008). By using the service you accept them. Specific commercial conditions are set out in the proposal accepted by each customer.

1. Scope of the service

Sunset is a platform to create, distribute and analyze questionnaires and surveys. The service is provided “as a service” via the web, with data stored in the European Union.

2. Accounts and customer responsibilities

The customer is responsible for safeguarding credentials, for the content of their questionnaires and for the lawfulness of their data collection — including privacy notice, legal basis and handling of data-subject rights towards their respondents, for whom they act as data controller. Sunset acts as processor under art. 28 GDPR.

3. Prohibited uses

The service may not be used for deceptive collection, spam, unlawful or harmful content, nor to attempt to breach data isolation between organizations or the security of the platform.

4. Plans, credits and free trial

Prepaid packages have no automatic renewal or charge; credits last 24 months. Only complete, valid responses are counted. The free trial is limited to 50 responses and is available once per organization. Features marked as launch promotion may change at the end of the communicated promotional period.

5. Availability and suspension

We are committed to keeping the service available and giving advance notice of planned maintenance. We may suspend accounts that violate these terms or compromise the security of the service, notifying the customer.

6. Data upon termination

Upon termination the customer can export their data; after the communicated period, the data is deleted.

7. Limitation of liability

To the extent permitted by law, B Best’s aggregate liability is limited to the amounts paid by the customer in the twelve months preceding the event. Nothing in these terms excludes liability that cannot be excluded by law.

8. Governing law

These terms are governed by Italian law. Any dispute falls under the jurisdiction of the controller’s courts, without prejudice to mandatory legal venues.
